PentaVideo.RU provides the multi-user Internet video conferencing services be means of the PentaChat Internet application with the use of a webcam connected to the User's computer and a text chat that is an inherent part of the PentaChat Internet application.
This User Agreement (hereinafter – Agreement) regulates the terms and conditions between the administration of the "PentaVideo.RU" service (hereinafter – Administration) and a physical or juridical person (hereinafter – User) regarding the use of the PentaVideo.RU service (hereinafter – Site) and the PentaChat application (hereinafter – PentaChat) by the user for the purpose of communicating with other Users. The User is a physical or juridical person who properly accepted this User Agreement and received one or several unique identifiers of the PentaChat Internet application (hereinafter – "PentaChatID") allowing you to arrange private video conferences.
1. Any Internet user can register at the Site and get access to PentaChat.
2. There are two main methods of using PentaChat:
• Personal PentaChat – PentaChatID that is the User's virtual private area limited by this Agreement. Personal PentaChatID is given to the user during registration at the Site.
• PentaChat for the User's site. The User can register additional PentaChatIDs in order to add PentaChat to his sites as an additional means of communicating for the visitors of the User's sites.
No matter how you use the PentaChat application, the User completely determines the access parameters, the style and norms of behavior in his PentaChat and is responsible for the contents of video conferences in it.
3 Terms and conditions of using the Site and PentaChat
3.1 The User agrees that he is entirely responsible for the registration data used to access PentaChatID and also the contents of video conferences held in PentaChat initiated with the User's PentaChatID. The Administration is not liable for the contents of the User's registration data, for video conferences held in PentaChat under the User's PentaChatID, for their legal status, for copyright violations, for unauthorized use of trade marks, company names and logos and also for possible violations of third parties' rights. In case of claims from third parties related to using the User's PentaChatID, the User will settle these claims on his own and at his own cost.
3.2 The User agrees that the Administration has the right to publish banners, advertisements, video clips and also other information at its discretion on pages of the Site with the User's registration information and also in PentaChat initiated with the User's PentaChatID.
3.3 By default, the User's registration data, except for the User's password and e-mail address, and also PentaChat initiated with the User's PentaChatID are available to all Users. Nevertheless, the User has the right to limit access for other Users to the above data and to the PentaChat application.
3.4 The contents of video conferences held in PentaChat initiated with the User's PentaChatID and also the User's sites PentaChat is added to must not:
• violate the law, the honor and dignity, the rights and interests of third parties;
• contribute to kindling religious, racial or international dissension, contain attempts to kindle hostility or calls for violence;
• popularize fascism and the ideology of racial superiority;
• be obscene or abusive;
• contain advertisements of narcotic substances, attempts to distribute drugs, methods of their production and advice how to use them;
• contain pornographic images and texts with the scenes of pedo-, zoo-, necrophilia and other sexual perversions;
• contain scenes of violence, cruel actions towards animals, etc.;
• contain the description of methods of suicide, any instigation towards it;
• violate the rights of minors;
• violate third parties' copyright and related rights;
• contain materials and/or technical solutions that automatically, without expressed prior permission from a user, add program code to the user's system or modifying the system settings of the user's operating system;
• contain computer viruses or software that can interrupt or interfere with the normal functioning of computer equipment and software and also telecommunications means of any persons.
3.5 The Administration has the right to refuse to register the User's PentaChatID and also remove the User's registration data at its own discretion if the contents does not comply with ethical and moral norms, violates the laws of the Russian Federation or violates the terms and conditions of this Agreement and the rules of the Site Administration. At the same time, the Site Administration does not have to notify the User about the reasons of such a refusal or removal.
3.6 The Administration tries to ensure the continuous work of the Site, but it is not responsible for the whole or partial loss of the User's registration data and also for the insufficient quality or speed of the video conferencing service provided by means of PentaChat.
3.7 In case this User Agreement is violated, in particular, while holding video conferences in PentaChat or publishing PentaChat on the User's site according to section 3.4 of this Agreement, the Administration can take the following measures towards any User of the site:
• disable the User's PentaChatID;
• disable the User's account;
• block the possibility of a new registration for the User.
4. This Agreement is a legal agreement between the User and the Administration.
5. All possible disputes regarding the relations regulated by this Agreement are settled according to the Russian legislation.
6. The User who thinks that his rights and interests have been violated because of the Administration's or third parties' actions related to the use of PentaChat, sends his claim to support@PentaVideo.ru.
7. The Administration can modify the User Agreement without any special notification. The latest version of the Agreement is available at http://www.pentavideo.ru/services_eng.php.
8. In case the authorities of the Russian Federation pass any legal regulations affecting the functioning of the Site partially or as a whole, the Administration reserves the right to make any changes in the functioning of the Site aimed at making the latter compliant with the new regulations.
